Amiga Inc. has nothing to do with Genesi and MorphOS team.

AmigaOS is copyright of Amiga Inc. but developed from Hyperion in Belgium.

AmigaOS is based on old Amiga Exec Kernel, and directly developed from its Motorola 68xxx version rewritten for PPC family of processors.

MorphOS it is based on a proprietary Microkernel called Quark. It has nothing in common with AmigaOS legacy.

It is just capable to run Amiga programs because has Amiga API 3.1 embedded into it and shares the same directories names and filesystems as AmigaOS.

So it is a completely new product that none could stop by sueing in court trial the Genesi firm.

There was another weird Amiga story beneath amiga Inc. and Genesi/MorphOS Team.

In the past Amiga Inc. has never released still any Amiga related product.

They spotted MorphOS which was at its first steps (0.4 version) and so Amiga Inc. declared that thet wanted MorphOS to became the new AmigaOS.

They signed a contrat with Genesi in which they offered the OS 3.1 sources and the name Amiga to MorphOS to develop the new OS under the common name of AmigaOS.

Due to a breaking of contract (they never released the source code) it was Genesi which sued Amiga Inc. in Federal Court in USA and won.

Amiga Inc. should had provided the name Amiga, AmigaOS to Genesi and had disclosed AmigaOS 3.1 sources.

But the orders of the Court were never accomplished.

Amiga Inc. affirmed that they had sold all Amiga Intellectual Properties claimed by Genesi/MorphOS team to another firm named KMOS Inc. one year before the contract with Genesi was broken.

Amiga Inc. said they owned nothing more related to AmigaOS. So they could not give anything to Genesi!

A very appropriate re-selling of Amiga Intellectual properties, and made JUST IN TIME to avoid court trial... What a lucky move for Amiga Inc...

(seems to me a move made by Amiga Inc. in retrospective and to avoid accomplish Federal Court orders. A very smart and extreme move.

It is a very common business trick, but if the judge is enough smart, then he could put you in jail for having declaring the false!)

But strange to know it, the judge believed the words by Amiga Inc.!

Then, sometime after the court trial the old Amiga Inc. based in Seattle was dismantled...

(to avoid any claims by any other creditors of any I.P. of Amiga brand name).

KMOS Inc. eventually was renamed Amiga Inc.

New Amiga Inc. was then transferred to Delaware, to obtain facilitations to industries whih are granted by State of Delaware USA.

(it is the new Amiga Inc. that has just sued Hyperion some days ago...)

So Amiga Inc. could never sue Genesi and MorphOS team!

Au contraire!

It is Amiga Inc. which lost the past Federal Court trial...

....and Genesi and MorphOS team could be entitled to use the name brand Amiga, if only Amiga Inc. of Delaware could be proved TO BE THE SAME OLD Amiga inc.

Unfortunately proofs apparently said that old Amiga Inc. was dismissed and new Amiga Inc. has nothing in common with "old" Amiga INC., except the fact they own all the intellectual properties of Amiga brand.

The recent history of Amiga it is well known as the best SOAP OPERA in the history of Computer Technology.

It is more intriguiging than Dallas, Dynasty, Twin Peaks, Beautiful tv serials!

"On the Edge; The spectacular rise and fall of Commodore" by author Brian Bagnall, Variant Press editor, price around 30.00 euros.

It is the story of Commodore from its foundation by Jack Tramiel, upto its demise.

And this is very illuminating.

But the story of Amiga AFTER Commodore: ->Gateway, ESCOM; Amino Inc., Amiga Inc. (1st), KMOS Inc., Amiga Inc. (2nd), this is yet to be written.
